What will happen if I don't finish paying the ''deposit'' on my new car to the dealership? ?

l was supposed to put down a deposit of $2000 dollars to the dealership. The deal went through and l gave $1000 and post dated a check for the rest. The check came back NSF because of a death in my family and l do not have the remaining $1000. Now the dealership is calling me with threat of an attorney. What can happen?

They can repossess your car. You have to realize you signed a contract, im sorry.

Ouch. Never been in that situation. Have you talked to the dealership about the situation you are in? Maybe they will cut you a break. give another month or so.

What you should do is have a look at the Fair Debt Collections Practices Act, and then wait for them to do something stupid that violates it.

Then, you sue them for thousands upon thousands of dollars for ''emotional distress'' and so on.

You presented payment that turns out to be fraudulent.

The dealership can sue u for the thousand dollars, & attorney is costs.

And, as a side note, they will win, because u gave them a bad check & signed a contract promising them the money. Also, depending on where u live, they can file a criminal charge for presenting a bad check that can actually send u to jail.

l think I'd go to the dealership & try to work something out, even if it is to give them fifty buck a week or something.

Tell them that if they are going get an attorney, you will do the same.
The contract is very shaky by them taking a ''post dated'' check. You can be sure that the finance company did not know about it. If they required 2K down and you actually just paid a thousand, they will have a problem with the dealer.

if u have signed a contract & a purchase agreement then u r obligated to buy the car. if u have given them cash of 1000.00 dollars & u re nig in the deal they can keep ur 1000.00 dollars & send in a bad report to the credit company is have u arrested for writing a Post Dated check. post dated checks r not legal so basically u r screwed.


on the other hand u might try talking to them (your sales man) & let them know what happened & show them proof u had a death in the family & then maybe they might cut u a bit of slack.

You r in a tough situation & that either way, u still owe the money, regardless of what everyone else has told u so far. They can sue u as stated by some of the . In order to buy time to pay it back & assuming that u financed it, tell them that u r going to contact the lender & see about making some arrangements to them. l am sure that nothing was mentioned to the lender about this side note. They made their decision to finance u based on the information provided by the car dealer.they misled the lender & u can ''hold'' this up to them but be subtle in doing this. Just tell them that u will contact the lender & see what kind of arrangements u can make with them.see if the ''choke'' & when the do (they will) volunteer to make partial payments until it is paid back.either way, u still owe it!

You can go to jail, receive a fine, & they can take ur car. That is check fraud. The law is different for each state & l included a link below. Contrary to what some others here think, the dealership did nothing wrong-- in fact they tried to do u a favor. Do what u can to borrow the $1000 if possible & put this behind you.

Chances are, the lender does not care about the NSF. In most cases the dealer will put up the funds so they can hand the deal over to the bank. The dealer takes a chance by doing this, but they get to roll a car. So the good news is that the bank probably wo not repo the car. The bad news is, the dealer may. But they do not want to take the car back any more than u want to give it back, so u should be able to work out a plan. Just do not dodge them. That just pisses us dealers off. Call & volunteer to help resolve the situation.

Oh, & next time do not buy a car that u can not afford. If u had purchased a $1000 car u would not be in this mess.
